Consolidated Appropriations Act of 2021

The Consolidated Appropriations Act of 2021 included a provision that Medicare beneficiaries must have an in-person visit with their behavioral health provider no more than six months before their initial telehealth appointment and annually thereafter, this was delayed until December 31, 2024. UNLESS CONGRESS ACTS this flexibility will end at the end of this year.

Key Considerations:

  • Start planning now
  • Review your current patient list to identify those who may be affected by this change
  • Consider adjustments to scheduling to accommodate more in-person appointments
  • Develop a communications plan to inform patients about the potential change and discuss options

The APA anticipates an extension when congress returns from Thanksgiving. However if there is not and you have not seen the Medicare patient in-person in 6-months prior to seeing them via telehealth, you will need to see them in person.
